These terms and conditions ("Terms") apply whenever you use this website, place an order or book a table with The Everest Cheltenham of 3-5 Portland St, Cheltenham, GL52 2NZ ("we", "us", "our").
Please read them carefully. By placing an order, making a booking or otherwise using our website you agree to these Terms. If you do not agree with them, please do not use the site.

2. Using our website
You may use our website only for lawful purposes and in line with these Terms. You agree not to misuse the site, attempt to gain unauthorised access to it, or use it in any way that could damage or impair it.
We try to keep the website available and accurate at all times, but we do not guarantee that it will always be uninterrupted, error-free or up to date. We may suspend, withdraw or change all or part of the site without notice.
3. Placing an order
When you place an order through our website it is an offer to buy the items in your basket. Your order is only accepted once we confirm it. If we are unable to accept your order — for example because an item is unavailable, we are closed, or your delivery address is outside our delivery area — we will let you know and will not charge you, or will refund any payment already taken.
Please check your order carefully before submitting it. It is your responsibility to make sure the items, quantities, delivery or collection details and contact details are correct.
We prepare food to order. Once we have started preparing your order it may not be possible to change or cancel it — please see the "Cancellations and refunds" section below.
4. Prices and payment
The price of each item is shown on our website and is in pounds sterling (£). Prices include VAT where applicable. We try to make sure all prices are correct, but if we discover an error in the price of items you have ordered we will contact you before continuing.
Any delivery charges, service charges or packaging fees are shown separately at checkout before you pay.
Card payments are processed securely by our payment provider, Stripe. We do not see or store your full card details. Where you pay in cash on collection or delivery, payment is due when your order is handed over.
5. Delivery and collection
Delivery is available only within the areas we serve, as shown at checkout. Delivery and collection times given at checkout are estimates and may vary, particularly during busy periods or bad weather.
Please make sure someone is available to receive a delivery at the address and time given. If we cannot deliver because no one is available or the details provided were incorrect, we may not be able to refund the order.
6. Allergies and dietary requirements
Our food is prepared in kitchens where allergens are present, so we cannot guarantee that any dish is completely free from a particular allergen, and there is a risk of cross-contamination.
If you have a food allergy or intolerance, please contact us directly before ordering so we can tell you about the ingredients in our dishes. Any allergen information shown on our website is provided as a guide only.

7. Cancellations and refunds
Because our food is freshly prepared to order, you do not have an automatic right to cancel once we have accepted and started preparing your order. If you need to change or cancel an order, please contact us as soon as possible and we will help where we can.
If something is wrong with your order — for example an item is missing, incorrect or not of satisfactory quality — please contact us promptly so we can put it right. Depending on the circumstances we may offer a replacement, a refund or a credit.
Any refunds are made to the original payment method and may take a few working days to appear, depending on your bank or card provider.
8. Table reservations
Where you book a table through our website, please arrive on time and let us know as early as possible if your plans change. We may hold a table for a limited period after the booking time before releasing it. Where a deposit is taken for a booking, the terms shown at the time of booking will apply.
9. Gift cards and vouchers
Gift cards and vouchers may be redeemed against orders as described at the time of purchase. Unless stated otherwise, they cannot be exchanged for cash, and any expiry date shown at purchase will apply. Please treat gift cards like cash — we cannot replace lost or stolen cards.
10. Your account
If you create an account with us, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Please let us know straight away if you think someone else has accessed your account.
11. Intellectual property
The content on this website — including text, images, logos, menus and branding — belongs to us or our licensors and is protected by law. You may view and use the site for your own personal, non-commercial use, but you may not copy, reproduce or reuse any part of it without our permission.
12. Our responsibility to you
We take care to provide our food and services to a good standard. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law.
Subject to that, we are not responsible for any loss that is not a foreseeable result of us breaking these Terms, or for any business losses (as our products are supplied for private, domestic use).
13. Changes to these Terms
We may update these Terms from time to time — for example to reflect changes in how we operate or in the law. The version published on this page at the time you place an order or make a booking is the version that applies.
14. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
